- The Concept of ”Personal Data” and the Basis for Processing
This refers to any information that allows the identification or identifiability of our customers, such as name, surname, IP, address, contact information, and bank account details.
The Law No. 6698 on the Protection of Personal Data, Law No. 6563 on the Regulation of Electronic Commerce, Law No. 6502 on the Protection of Consumers, the Regulation on Service Providers and Intermediary Service Providers in Electronic Commerce, and the Regulation on Commercial Communication and Commercial Electronic Messages contain provisions regarding the processing and protection of personal data.
As MES BISOUS, we need to process the personal data of our members and customers within the framework of Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts, both to fulfill our obligations arising from the contracts we establish with you and to provide you with the best service. - Reasons for Processing Your Personal Data
Your personal data will be processed for all kinds of business and transactions related to the products and services we offer, such as recognizing our customers through CRM (Customer Relationship Management) channels, understanding their needs, developing personalized services and products, managing customer relationships by ensuring the sharing of this information within the organization, using it in our active launch and campaign announcements held regularly every month, and providing information priority for products preferred more by you, our customers.
To provide you with quality service, we will need information such as name, surname, e-mail address, phone number, gender, date of birth, personal interests, billing and delivery addresses when you subscribe to our e-newsletters announcing our campaigns, become a member of our site, purchase our products directly or through our site, or cancel the products you have purchased. We will use this information to manage order processes and ensure customer satisfaction. Apart from this information, anonymous aggregate statistical data that does not contain personal information, such as site visit frequency and times, order times, IP address at the time of order, and statistics of visited product pages and ordered products, are also collected and used to analyze and understand visitor movements and preferences.
MES BISOUS may use your information to provide more effective service, improve the site and its products or services, make the site easier to use by eliminating the need to enter the same information repeatedly, or provide personalized content according to your specific site preferences and interests.
When you agree to receive promotional e-mails providing information about campaigns, MES BISOUS associates your sales information with your personal information to send you suitable e-mails. Every e-mail includes unsubscribe links that allow you to stop receiving such messages. - Transfer of Your Personal Data
Your personal data may be shared with our domestic and international subsidiaries and affiliates, provided that it complies with the procedures and principles stipulated in the Law. Additionally, your personal data may be shared with third-party companies that are our domestic and international business partners for the purpose of sending you informative, advertising, promotional messages, etc. Furthermore, to create an efficient and profitable economic enterprise, MES BISOUS may share your personal data with various partner companies, individuals, or group companies from which it receives services or cooperates, including tax, accounting, and financial consultancy firms, law firms, IT firms, independent audit firms for security auditing services, marketing firms, transportation firms, or other financial institutions.
MES BISOUS may share the personal data it collects with program partner institutions and organizations with which it cooperates to carry out its activities, with domestic/international persons and institutions from which it receives cloud data storage services, with domestic/international organizations contracted for sending commercial electronic messages to customers, with cargo companies, with the Interbank Card Center, with auxiliary tools within the scope of various marketing activities to provide better service and customer satisfaction, with various domestic and international agencies and advertising companies, with survey companies, with other domestic/international third parties, and relevant business partners.
The processing of your personal data by MES BISOUS without explicit consent is only possible in a limited number of cases specified in the Law No. 6698 on the Protection of Personal Data. MES BISOUS may transfer your personal data to fulfill its obligations arising from the law, to comply with legal and administrative proceedings notified to MES BISOUS, to protect and defend its rights and property, and within the scope of activities carried out by public institutions and organizations authorized by law to ensure national defense, national security, public safety, public order, or economic security.
Your credit card information requested on the payment page is not kept on the servers of MES BISOUS or the companies serving it in any way, in order to keep the security of our customers shopping on the site at the highest level. - Method of Collecting Your Personal Data
Your personal data is collected through various methods—fully or partially automated or non-automated as part of any data recording system—including the program we use for your store purchases, our website, e-mail, SMS, or information you transmit to us via other means, as well as the identification system called "cookies," which helps our computers recognize you automatically during your visit to our website or during payments for purchases made at our stores or via our website. You can delete all cookies or site-related data from the tools section of your internet browser and reject all cookies from the help section.
MES BISOUS attaches great importance to the security of our customers' and members' information and works with state-of-the-art tools. To ensure the security of our site, all kinds of physical, electronic, and managerial measures have been taken in secure environments. All information is stored and backed up on secure servers. - Processing Period of Your Personal Data
MES BISOUS retains personal data for the period stipulated by law, for the period necessitated by the purpose of processing, or for the relevant legal periods in cases where it may be necessary for MES BISOUS to protect and use its rights in possible future legal processes, in order to act in accordance with legal requirements and fulfill legal proceedings. At the end of this period, the personal data belonging to our customers will be deleted, destroyed, or anonymized by the Company.
Personal data processed for the purposes specified in MES BISOUS's policy will be deleted, destroyed, or anonymized by MES BISOUS when the purpose requiring processing under the KVKK (GDPR) ceases to exist and after the periods determined under the Turkish Commercial Code No. 6102, the Regulation on the Deletion, Destruction or Anonymization of Personal Data published in the Official Gazette dated October 28, 2017, and numbered 30224, and the Turkish Penal Code No. 5237 have passed. - Your Rights Under the Law
Pursuant to Article 11 of the Law, you have the right to: learn whether personal data is processed, request information if it has been processed, learn the purpose of processing and whether it is used in accordance with its purpose, know the third parties to whom it is transferred domestically or abroad, request correction if it is processed incompletely or incorrectly, request the deletion or destruction of personal data within the framework of the conditions stipulated in Article 7 of the Law, request notification of the corrections, deletions, or destructions made to third parties to whom it was transferred, object to a result against you arising from the analysis exclusively through automated systems, and demand compensation for damages if you suffer loss due to unlawful processing. - Updating Your Personal Data and Your Right to Apply
As personal data owners, if you submit your requests regarding your rights to MES BISOUS using the methods regulated below, MES BISOUS will conclude the request free of charge within thirty days at the latest, depending on the nature of the request. However, if the transaction requires an additional cost, you will be charged within the limits set by the legislation.
MES BISOUS concludes your request within thirty days at the latest. If MES BISOUS informs you in writing, no fee is charged for this process up to 10 pages. MES BISOUS may charge 1 Turkish Lira for each page over 10 pages. If MES BISOUS informs you via CD or flash memory, the fee requested will not exceed the cost of the CD or flash memory. If MES BISOUS rejects the request in the application, it notifies its answer in writing or electronically. In cases where the application is rejected, the answer is found insufficient, or the application is not answered by MES BISOUS in time, you may file a complaint with the Board within thirty days from the date you learn of MES BISOUS's answer and, in any case, within sixty days from the date of application. If MES BISOUS accepts the request in the application, it fulfills the requirements, and the application fee received from you is refunded if the error lies with MES BISOUS.
You can submit your request regarding the exercise of your above-mentioned rights to MES BISOUS by using a written form, registered electronic mail (KEP) address, secure electronic signature, mobile signature, or the electronic mail address previously notified by you to MES BISOUS and registered in MES BISOUS's system, or through a software or application developed for the purpose of the application, by adding the relevant information and documents. In this context, the channels and procedures for submitting your written application to MES BISOUS are explained below.
In the application, it is mandatory to include:
• Name, surname, and signature if the application is in writing,
• T.R. identity number for citizens of the Republic of Turkey; for foreigners, nationality, passport number, or identity number if available,
• Residential or workplace address for notification,
• E-mail address, telephone, and fax number for notification, if any,
• Subject of the request.
To exercise your rights stated above, you may submit your request—including the necessary information to identify you and explanations regarding the right you wish to exercise among those specified in Article 11 of the Law—by:
Delivering it in person with identification documents to 42 Maslak Sitesi No:4 Sarıyer / İstanbul, sending it via registered mail, through a notary, or other methods explained above, or sending it with a secure electronic signature to the info@mesbisous.com address or one of the KEP addresses.
As MES BISOUS, we undertake to make the necessary updates following any changes that may be made to the legislation regarding personal data.
