Within this Preliminary Information Form (“Form”), the consumer (“Buyer”) and MB Kozmetik Pazarlama ve Ticaret A.Ş. (“Seller”) shall be referred to individually as “Party” and collectively as “Parties.”
1- Purpose
The purpose of this Form is to inform the Buyer regarding the terms and conditions for the sale and delivery of products ordered electronically via the Seller's website www.mesbisous.com (“Website”) and to determine the mutual rights and obligations of the Parties. These rights and obligations shall apply to all products offered for sale by the Seller on the Website.
In accordance with the Law on the Protection of the Consumer (“Law”) and the Regulation on Distance Contracts (“Regulation”), the Buyer is hereby provided with information regarding the order specified in Article 2 below. Should the Buyer confirm the said order, they must also conclude a Distance Sales Contract (“Contract”).

Article – 5 GENERAL PROVISIONS
5.1 Product Price
The sales prices specified in TL on the Website, which are valid at the time the Buyer places the relevant order, shall apply to the products. The sales price of the products on the Website may be changed by the Seller from time to time. Such changes shall not affect orders already placed by the Buyer. The sales prices stated on the Website are valid only for remote distance sales.
The sales prices stated on the Website do not include shipping fees; the shipping fee will be added separately to the price of the purchased products. The shipping fee will be specified by the Seller before the order is recorded.
The sales prices stated on the Website include Value Added Tax (VAT).
5.2 Basic Characteristics of the Product
The Buyer may select one or more products from different categories on the Website.
The Seller may change the variety of products offered for sale on the Website at any time, particularly due to reasons arising from suppliers. Such changes shall not affect orders already placed by the Buyer.
The products offered for sale on the Website comply with the current Turkish Legislation.
5.3 Product Stock Information
Special offers, promotions, campaigns, or discounts shall be valid on the specified dates and/or until stocks are exhausted. The Seller has the authority to cancel orders in cases such as system rule violations and system errors regarding special rights such as points and discounts given on the Website. No claim can be made against the Seller in this regard.
Product stock information is notified to the Buyer at the time of ordering. Exceptions regarding errors or changes in this information may occur due to technical reasons. In cases where some or all of the products are out of stock for any reason, the Buyer will be informed after the order is placed about when the products can be provided or whether the order has been partially or completely canceled.
5.4 Order
Placing an order by the Buyer constitutes acceptance of the “Legal Warning and Terms of Use” and “Policy on Protection of Personal Data and Cookies” texts on the Website.
All orders are processed in accordance with these provisions and the “Legal Warning and Terms of Use” and “Policy on Protection of Personal Data and Cookies” texts on the Website.
Before confirming the order, the Buyer can verify the final details of their order and correct any errors.
For the delivery of the product subject to the Contract to the Buyer or the person notified, it is mandatory that this Form and the Contract have been approved by the Buyer and the full sales price has been paid. If for any reason the product price is not paid in full or in part, is canceled in bank records, or any fraudulent transaction or attempt is detected in the use of the Website, the Seller is deemed to be released from the obligation to perform the order and deliver the product.
5.5 Payment
The Buyer may use the payment methods specified below. The Buyer accepts and declares that they possess all necessary legal permissions/status regarding the methods they prefer for payment.

5.7 Delivery
The Seller shall deliver the order placed by the Buyer to the delivery address specified in Article 4 within the committed period, and in any case, within 30 (thirty) days from the date the order reaches them.
The Seller is responsible for delivering the product sound, complete, in accordance with the specifications specified in the order, and together with warranty documents and user manuals, if any.
If the Seller cannot deliver the product within the period due to force majeure, it is obliged to notify the Buyer. In this case, the Buyer may exercise one of the rights to cancel the order and receive a refund, and/or replace the product subject to the contract with its precedent if available, and/or postpone the delivery period until the obstructive situation disappears.
5.8 Defective Products
The Buyer or the third parties receiving the order must check the product boxes and packaging as well as the external appearance of the product during delivery.
In cases where the product box is open, damaged, or has liquid stains, or there is an unusual situation in the products (missing or broken/damaged products), or the wrong product has arrived, the Buyer or the third party receiving the order must follow the procedure below.
First of all, please do not open the box/packaging (tape and/or seal if any); otherwise, your return request will not be met. To create your request, send an e-mail to info@mesbisous.com within 14 (fourteen) days. After initiating the return process, you may deliver the product to the contracted cargo company together with the code number, invoice, or waybill document that will be provided to you. The product(s) and your request will be examined, and you will receive feedback as soon as possible. If your request is found justified, all payments made by you, including the shipping costs for the returned product, will be refunded to you within 14 (fourteen) days in accordance with the payment method used during purchase.
5.9 Suggestions and Complaints
For all your questions, complaints, and suggestions regarding the products offered for sale on the Website and their use, you can leave a message by clicking on the “Contact Us” tab on the Website.
6- Right of Withdrawal
Regarding the products you have purchased, you may exercise your right of withdrawal within 14 (fourteen) days from the date you receive the product or the product is delivered to the third party specified, without providing any justification and/or paying any penalty. You may also exercise your right of withdrawal within the period until the delivery of the relevant product to you.
In order to exercise the right of withdrawal, according to subparagraph (ç) of paragraph 1 of Article 15 of the Regulation regarding “contracts for the delivery of goods whose protective elements such as packaging, tape, seal, packet have been opened after delivery; those whose return is not suitable in terms of health and hygiene,” the protective elements of the relevant product such as packaging, tape, seal, or packet must definitely not be opened; otherwise, your return request will not be met. To create your request, fill out the Return Form regarding the order you wish to return through your Website account or by logging into the Website with your order number within 14 (fourteen) days. After filling out the Return Form, you may deliver your product to the contracted cargo company together with the code number, invoice, or waybill document that will be provided to you. The product(s) and your request will be examined, and you will receive feedback as soon as possible. If your request is found justified, all payments made by you, including shipping costs for the returned product, will be refunded to you within 14 (fourteen) days in accordance with the payment method used during purchase.
The Seller cannot be held responsible for delays and disruptions caused by banks in the refund of the product price.
Returns will not be accepted through any cargo company other than the contracted one specified in this Form.
According to the Regulation, the right of withdrawal cannot be used in the following cases:
a) Contracts for goods or services whose price changes depending on fluctuations in financial markets and which are not under the control of the seller or provider.
b) Contracts for goods prepared in accordance with the consumer's wishes or personal needs.
c) Contracts for the delivery of goods that can perish quickly or reach their expiration date.
ç) Contracts for the delivery of goods whose protective elements such as packaging, tape, seal, packet have been opened after delivery; those whose return is not suitable in terms of health and hygiene.
d) Contracts for goods that are mixed with other products after delivery and which cannot be separated by nature.
e) Contracts for books, digital content, and computer consumables presented in material form if the protective elements such as packaging, tape, seal, packet have been opened after the delivery of the goods.
f) Contracts for the delivery of periodicals such as newspapers and magazines, except those provided under a subscription agreement.
g) Contracts regarding the evaluation of leisure time for accommodation, transport of goods, car rental, food and beverage supply, and entertainment or recreation, which must be performed on a specific date or period.
ğ) Contracts regarding services performed instantly in an electronic environment or intangible goods delivered instantly to the consumer.
h) Contracts regarding services whose performance started with the consumer's approval before the expiration of the right of withdrawal period.
We would like to emphasize particularly that, as explained above, the use of the right of withdrawal for cosmetic products is subject to the condition that the product's packaging is unopened, intact, and the product is unused.
7- Venue for Dispute Resolution
In case of dispute, an application can be made to the Consumer Arbitration Committee or Consumer Courts depending on the value of the product.
The Buyer accepts and declares that they have been informed on all matters included in Article 5 of the Regulation and that they are aware they will be under a payment obligation if they confirm the order and the Contract.
